Insurers seek legal options to avoid deluge of pandemic claims
Insurers are examining their options to avert a potentially ruinous deluge of business interruption claims, following a surprise NSW Court of Appeal ruling that deemed incorrectly worded pandemic exclusions policies to be void. The ruling, which took insurers by surprise, will open the way for thousands of claims from mostly smaller businesses that were forced to close as a result of the coronavirus pandemic – such as bars, restaurants, retail stores and tourism operations – providing a lifeline to those businesses but potentially costing insurers hundreds of millions of dollars.
